1. Operator and application of these terms

This website is operated by JACO ASSET HOLDINGS LIMITED TAIWAN BRANCH (HONG KONG). These terms apply to www.jaco.com.tw and related accounts, product searches, enquiries, quotations, orders, payments, delivery and after-sales support.

Before placing an order, you must have a reasonable opportunity to review and save these terms and the relevant transaction information. Individually negotiated quotation or order terms take priority over these standard terms where they conflict. Mandatory or prohibitory law always prevails.

The parties may use electronic documents. An electronic document exchanged under these terms has the same effect as a written document if its content can be fully presented and retrieved for later inspection, except where applicable law provides otherwise.

2. Eligibility and account security

  • Individual users must have legal capacity under Taiwan law. Anyone acting for a company or organisation must have authority to do so.
  • Registration and transaction information must be truthful, complete and kept current. You must not impersonate another person, create a misleading account or evade transaction restrictions.
  • Keep sign-in information secure and notify us promptly of unauthorised use. Once we learn that an account has been misused, we will immediately suspend processing and further use of transactions arising from that account while assisting with the investigation.

3. Product information, ordering and contract formation

The product name, price, content, specification, model, compatibility, stock or lead time and other information on the transaction page form part of the transaction according to their nature. Variants may have different prices, stock, warranties and delivery terms, so confirm the item or variant selected before ordering.

You select quantity and price through the website confirmation mechanism and submit an order. For consumer transactions governed by Taiwan’s mandatory online-retail terms, JACO accepts the order unless it rejects it with a legitimate reason within two working days after submission; if payment has been received, the contract is treated as formed under those rules. A quotation forms a transaction when accepted within its validity period on the stated terms.

Out-of-stock goods, unlawful supply, an obvious and recognisable system error, unauthorised payment, an unserviceable destination or suspected fraud may be legitimate grounds for rejection or cancellation. We will not unilaterally substitute specifications, origin or accessories; your consent is required for a substitute.

4. JACO direct sales and responsibilities

All goods on the Taiwan website are sold by JACO ASSET HOLDINGS LIMITED TAIWAN BRANCH (HONG KONG) (JACO). Your sale contract is directly with our company. We are responsible for fulfilling orders, receiving payment for our goods, issuing invoices or transaction records as required by law, arranging delivery, and handling returns, refunds and after-sales service.

Brands, manufacturers, suppliers, carriers and repair centres may assist us in supplying goods or providing services. This does not change our identity or responsibilities as your contracting seller. Your payment is for goods sold by our company; payment providers supply payment processing services.

Neither our transaction terms nor our service providers’ procedures may exclude or limit mandatory consumer rights.

5. Price, payment, invoices and delivery

  • The Taiwan storefront displays prices in New Taiwan dollars. Tax, discounts, shipping and the order total are calculated from the actual product, quotation or checkout information and shown before confirmation.
  • Available payment methods, deadlines and third-party payment providers are described at checkout or in the quotation. You authorise us and the provider to process payment data needed for the transaction, fraud prevention and refunds.
  • JACO issues invoices or transaction records under applicable tax law using the details you provide. Check any Unified Business Number or carrier information before confirming the order.
  • The checkout, quotation or order confirmation states the destination, method, estimated timing and shipping charge. Estimates may be affected by stock, carriers, remote areas, weather, customs or force majeure; reasonable notice will be given for delays.

6. Returns, refunds and warranties

Returns and refunds follow the Return & Refund Policy, the item-specific notice and applicable law. Consumers in a distance sale covered by the Consumer Protection Act have a seven-day rescission right after receipt, except for a statutory exception clearly disclosed in advance.

Defect rights, product safety and warranties follow the Warranty & After-Sales Policy, item-specific documents, the Civil Code, the Consumer Protection Act and other applicable law. A commercial warranty supplements rather than replaces non-excludable statutory rights.

7. Lawful use and prohibited conduct

  • Do not use the website for unlawful, fraudulent, infringing, harassing, money-laundering, sanctions-evasion or unsafe activity.
  • Do not access accounts, systems or data without authorisation, distribute malware, disrupt services, or use unreasonable automated traffic to scrape, test or manipulate the site.
  • Do not upload unlawful, infringing or false material or unnecessary sensitive personal data. You must have the right to provide procurement lists, images, documents and other materials.
  • Regulated, hazardous or professional-use goods must be purchased, installed and used in accordance with labels, instructions, law and safety procedures.

8. Intellectual property and user content

Website software, layout, the JACO brand and content produced by us are protected by intellectual-property law. You may use the site only for lawful procurement and internal evaluation and may not copy, adapt, distribute, reverse engineer or remove rights notices without authorisation. Product marks, images and manufacturer material may belong to their respective owners.

You retain rights in lawful content you upload and grant JACO a non-exclusive licence to use, reproduce, transmit and provide it to our contracted service providers only as needed for enquiries, quotations, transactions, support, security and after-sales service.

9. Service maintenance, account restrictions and changes

We may suspend parts of the service for maintenance, security, legal requirements or force majeure and will reasonably minimise the impact. Proportionate restrictions may be imposed for illegality, fraud, material breach or security risk, but existing transactions and statutory rights do not automatically end with an account restriction.

Updated terms state their effective date and do not apply retrospectively to the detriment of an existing transaction. Material changes will be reasonably notified. Any wording purporting to let us unilaterally change an existing contract, disregard advertising or transaction records, or restrict statutory rights does not apply.

10. Responsibility and liability

Each party is responsible according to its transaction role, individually agreed terms and applicable law. For non-consumer business transactions, any indirect, special or consequential loss is assessed, to the extent permitted by law, under foreseeability, causation, mitigation and the parties’ individual agreement.

These terms do not exclude or limit liability that cannot lawfully be excluded, including wilful misconduct or gross negligence, fraud, personal injury, product safety and product liability, principal obligations of an existing transaction, or mandatory consumer rights.

11. Complaints, governing law and jurisdiction

For a dispute, email enquiry@jaco.com.tw with the order or quotation number and a summary. We will acknowledge it and properly handle a consumer complaint within 15 days as required by the Consumer Protection Act. Consumers may still complain or seek mediation through a consumer advocacy group, local government consumer service centre, consumer ombudsman or consumer dispute mediation commission.

These terms and transactions are generally governed by the laws of the Republic of China (Taiwan). For non-consumer business disputes, the parties agree that the Taiwan Taipei District Court has first-instance jurisdiction. This does not exclude the jurisdiction available under Article 47 of the Consumer Protection Act, small-claim jurisdiction under the Code of Civil Procedure or any other mandatory rule.

12. Language and severability

These terms are available in Traditional Chinese and English. Traditional Chinese is the principal reference for Taiwan transactions, but this language clause cannot reduce any legal right. If a provision is invalid or does not form part of the contract, the remainder continues only to the extent the contract can stand and is not manifestly unfair.

The official Chinese text prevails where an English translation differs.
