1. Scope and transaction status
This policy applies to goods you buy from JACO ASSET HOLDINGS LIMITED TAIWAN BRANCH (HONG KONG) (JACO) at www.jaco.com.tw. It forms part of the transaction together with JACO’s product page, quotation, order confirmation and applicable law. JACO receives and is directly responsible for handling return, exchange and refund requests.
Whether a purchaser is a “consumer” is determined by the actual transaction purpose under the Consumer Protection Act. A qualifying distance-sale consumer has the statutory rights below. Procurement solely for business operations, production, resale or professional use is governed by the individually agreed terms, the Civil Code and other applicable law. An account name or Unified Business Number is not the only deciding factor.
2. Seven-day distance-sale rescission right
Except for a statutory exception in section 3 that was clearly disclosed before the transaction, a consumer covered by the Consumer Protection Act may rescind within seven days after receiving the goods by returning them or sending written notice to enquiry@jaco.com.tw, without giving a reason or bearing any expense or cost. Dispatching the goods or written notice within the statutory period is sufficient.
If the legally required rescission information was not provided when the goods were received, the seven-day period starts under Article 19 of the Consumer Protection Act after the information is later provided, subject to that Article’s statutory long-stop period. JACO’s terms cannot shorten, exclude or add a cost to this right.
The seven days are a cooling-off period, not a trial-use period. Opening or inspecting an item as reasonably necessary to understand its nature, function and condition does not automatically end the right. The consumer may have to compensate proportionately for proven loss in value caused by handling beyond necessary inspection.
3. Statutory exceptions
The seven-day right is excluded only if the goods or services fall within a statutory category below and JACO clearly informed the consumer before the transaction. Without clear notice, the exception is not used to exclude the right.
- Goods liable to deteriorate rapidly, with a short shelf life, or close to expiry when rescinded.
- Customised goods supplied according to the consumer’s requirements, such as goods cut to a specified size, engraved or specially assembled.
- Newspapers, periodicals or magazines.
- Sealed audio-visual products or computer software after unsealing.
- Intangible digital content or online services completed once supplied, where the consumer agreed in advance to supply.
- Sealed personal-hygiene products after unsealing.
- International air passenger services.
4. Inspection, packaging and diminished value
- Where reasonably possible, keep the goods, accessories, gifts, manuals, warranty documents and packaging and return them with protective packaging. Original packaging is not an absolute condition of statutory rescission, although missing items or damage from inadequate packing may affect restitution.
- The rescission right does not end where damage, loss or alteration resulted from necessary inspection or a cause not attributable to the consumer.
- If use goes beyond what could reasonably be inspected in a physical shop and causes proven loss in value, JACO may seek proportionate compensation under law, but will not reject a statutory return merely because the package was opened.
5. Defective, incorrect or transit-damaged goods
For an incorrect item, shortage, transit damage, failure to operate or non-conformity with the agreed specification, contact us promptly after discovery and keep the item, shipping carton, carrier label and useful photos or video. Prompt notice helps carrier review, but an internal 24- or 48-hour deadline will not extinguish statutory defect or damages rights.
The seven-day rescission right and defect remedies are separate. Even after the cooling-off period, original defects may support repair, replacement, price reduction, rescission or damages under the Civil Code, Consumer Protection Act, an item warranty or other applicable law.
6. Request and return process
- Email enquiry@jaco.com.tw with the order number, contact details, item and quantity, and state whether you are exercising statutory rescission or reporting an item issue. A no-reason statutory rescission does not depend on giving a reason or photos.
- JACO receives your request and arranges collection and the return destination. Do not ship to the registered office before the receiving details are confirmed.
- After written statutory rescission, JACO will collect from the original or agreed delivery place within 15 days after receiving notice unless the parties individually agree otherwise.
- For an approved non-consumer business return, exchange or repair, the agreed return number, shipping method and timing will be provided.
7. Refund method, timing and shipping costs
- A consumer exercising the statutory seven-day right bears no necessary return cost. JACO refunds the consideration within 15 days after collecting the goods, receiving the returned goods, or receiving notice rescinding a service contract.
- JACO bears reasonable return costs for an incorrect shipment, original defect or transit damage attributable to JACO.
- Other individually agreed non-consumer or non-defect returns follow the pre-disclosed agreement on original shipping, return costs, refurbishment and diminished value.
- Refunds normally go to the original payment method. If that is impossible, we securely verify an alternative. Bank, card and payment-provider posting operations are outside our control but do not alter JACO’s statutory duty to return the paid consideration within the required period.
8. Exchanges and follow-up
Exchanges depend on stock and supply. If the same item is unavailable, an appropriate refund or other remedy is offered according to law and the transaction. We will not substitute a different specification, origin or accessory without consent.
JACO is directly responsible for return and exchange requests, follow-up and refunds. More favourable, valid terms on a product page or individually agreed in writing apply where offered. Supplier, brand or carrier procedures do not limit your statutory rights.
9. Contact and consumer disputes
Email enquiry@jaco.com.tw about a return or refund. We will properly handle a consumer complaint within 15 days after receipt. A consumer may also complain or seek mediation through a consumer advocacy group, local government consumer service centre, consumer ombudsman or consumer dispute mediation commission.
